1.3.3 Telephone number - necessary for fulfilling the order and ensuring its fulfillment, incl. For transmitting service error messages;
1.3.4 Address - required for order fulfillment and product delivery.
Data collection when filling in the contact form:
1.4 When filling in the forms, the data to be submitted by the User are divided into mandatory and voluntarily transmitted data.
1.5 It is obligatory for the Contracting Authority to provide the following information:
1.5.1 Name - required to fill in and send the letter;
1.5.2 E-mail address - necessary for filling in and sending the letter and, if necessary, replying to the User;
1.5.3 Telephone number - necessary for filling in the letter and ensuring its fulfillment, incl. For sending service error messages.
1.5.4 Message - required to fill in a message and send a message.
Data collection when subscribing to email:
1.6 It is mandatory for the Contracting Authority to provide the following information:
1.6.1 It is mandatory to enter an e-mail address when subscribing to e-mail.
1.7 Separate consent to the transfer of data has been given The Subscriber has given consent to the use of his / her contact details for the purpose of direct marketing, ie notifications of a marketing nature are sent to him / her using the contact details provided by him / her.
1.8 The Subscriber has the right at any time to opt out of receiving notices sent for direct marketing purposes. Instructions for opting out of commercial communications are included with each commercial communication.

1.12 The Customer has the right to demand that West Tree OÜ terminate the use of its data and correct, close and delete the data;
1.13. The Subscriber has the right to agree or prohibit the use of his / her data for direct marketing or marketing purposes;
1.14 The Subscriber has the right to turn to the Data Protection Inspectorate and the court to protect their rights.

2.2 Domains belonging to West Tree OÜ may, among other things, contain an element that stores cookies on behalf of third parties.

* Purchases made on Saturday, Sunday and public holidays will be delivered to the customer on the next working day.
3.2 Coming to order yourself

3.3 Terms of sale
3.3.1 The owner of the online store westtree.eu (hereinafter the Online Store) is West Tree OÜ, registry code 14373584, location Lääne county, Haapsalu city, Koheri village, Koheri-Otsa, 90434, Estonia.
3.4 Validity of the sales contract, goods and price information
3.4.1 The Terms of Sale apply to the purchase of goods from the Online Store.
3.4.2 The prices of the products sold in the online store are indicated next to the products. Please note that there may be a charge for the delivery of the goods.
3.4.3 The delivery fee depends on the method of delivery. The delivery fee is displayed to the buyer when ordering.
3.4.4 Information about the goods is provided in the Online Store directly next to the goods.
3.5 Description of payment methods and currency
3.5.1 In the e-shop, you can pay through a secure payment center with all Estonian payment cards and Internet bank accounts (Swedbank, SEB, Danske Bank, Krediidipank, LHV, Nordea). The settlement currency is the Euro (€). The goods offered in the e-shop include VAT.
Payments are mediated by PaySera.
3.5.2 You can also pay on the basis of an invoice in the e-shop, in which case after clicking the “SUBMIT ORDER” button, we will send an invoice to the e-mail address entered on your order form. Make a transfer to the West Bank OÜ SEB bank account according to the invoice information received from the e-mail address: EE031010220266929229 and indicate your order number in the payment description / explanation. Your order will not be shipped until the funds have reached our account.
3.6 Making an order
3.6.1 To order goods, the desired products must be added to the shopping cart. To place an order, you must fill in the required data fields by entering your personal data. We confirm that we maintain the security of your personal data.
3.6.2 After filling in the personal data form, the appropriate method of delivery of the products must be selected. The amount of the fee, which can be paid via a bank link or another payment solution, is then displayed on the screen.
3.6.3 The Agreement enters into force upon receipt of the amount due to the current account of the Online Store. We will send you an e-mail confirmation of the order and we will also display a confirmation of the acceptance of the order on the website.
3.6.4 If the ordered goods cannot be delivered due to the end of the goods or for any other reason, we will notify the buyer as soon as possible and refund the money paid (incl. Delivery costs) immediately, but not later than within 14 days of sending the notice.
3.7.1 We order goods ordered from the westtree.eu online store only within Estonia. In case of international delivery, a surcharge of at least 10 € will be applied to each order, plus VAT *.
* If there is more than one West Tree product in the order, West Tree OÜ may increase the amount of the international delivery price, but will negotiate and agree on it in advance by e-mail or telephone with the Customer, ie with you.
3.7.2 Shipping costs are borne by the buyer and the corresponding price information is displayed next to the shipping method.
3.7.3 Shipments within Estonia will generally reach the destination specified by the buyer within 2-5 working days from the entry into force of the sales contract.
3.7.4 In exceptional cases, we have the right to deliver the goods within 45 calendar days.
3.8 Right of withdrawal
3.8.1 After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days. The right of withdrawal does not apply if the buyer is a legal person.
3.8.2 In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in the manner permitted for testing the goods in a physical store.
3.8.3 If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the goods or have signs of use or wear, the Online Store has the right to reduce the refundable fee according to the decrease in the value of the goods.
3.8.4 To return the goods, please submit a return application to us at email@example.com no later than 14 days after receipt of the goods.
3.8.5 The costs of returning the goods shall be borne by the buyer, unless the reason for the return is due to the fact that the goods to be returned do not correspond to what was ordered (eg a defective or defective product).
3.8.6 The Buyer must return the goods within 14 days of sending the e-mail or provide proof that he has handed over the goods to the carrier within the aforementioned period.
3.8.7 The online store shall return all fees received from the buyer on the basis of the contract to the buyer immediately upon receipt of the returned goods, but not later than 14 days after receipt of the withdrawal application.
3.8.8 The online store may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided proof that he has returned the item, whichever is earlier.
3.8.9 If the Buyer has explicitly chosen a delivery method different from the cheapest usual delivery method offered by the Online Store, the Online Store does not have to reimburse the consumer for a cost that exceeds the cost related to the usual delivery method.
3.9 The online store has the right to withdraw from the sale transaction and reclaim the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.
4. RIGHT TO SUBMIT A COMPLAINT
4.1 The online store is liable for non-compliance or defect of the goods sold to the buyer, which already existed at the time of delivery of the thing and which becomes apparent within two years from the delivery of the goods to the buyer. During the first six months from the delivery of the thing to the buyer, it is presumed that the defect already existed at the time of delivery of the thing. It is the responsibility of the Online Store to rebut the respective presumption.
4.2 In the event of a defect, the Buyer has the right to contact the online store within two months at the latest by sending an e-mail to firstname.lastname@example.org or by calling (+372) 5628 8111.
4.3 The online store is not responsible for defects that have occurred after the delivery of the goods to the buyer.
4.4 If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will return all fees associated with the sales contract to the buyer.
4.5 The online store shall respond to the consumer's complaint in writing or in a form that can be reproduced in writing within 15 days.
5. SETTLEMENT OF DISPUTES

5.2 If the Buyer and the Online Store are unable to resolve the dispute by agreement, the Buyer may turn to the Consumer Disputes Committee. The terms of the procedure can be viewed and the application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer's complaint in the commission is free of charge.
5.3 The buyer can turn to the European Union Consumer Dispute Resolution Platform.
6. RENTAL CONDITIONS
6.1 The minimum time to rent a spruce baby is one week and the maximum time is 1 month.
6.2 When renting a sixth baby, you pay 9.90 euros (for a spruce baby) + 10.00 euros (deposit) for a total of 19.90 euros (including VAT).
6.3 When returning a well-groomed and live spruce baby on the agreed date within a week, we will refund you a deposit of 10.00 euros (including VAT).
